Terms of Use.
The short version: use your judgment.
These terms govern use of the public Kill Dull website. They do not govern private engagements with the Bench. Those are subject to separate terms agreed with the client.
The site
Kill Dull publishes information, ideas, research, opinions and judgments about marketing and related subjects. We try to get things right. We can still be wrong.
Nothing on this public site should be treated as legal, financial or other professional advice, or as a substitute for your own judgment.
The Bench
Published material about the Bench explains what the service does. It is not itself an offer, engagement or client agreement.
A Bench verdict is an independent marketing judgment. What a company decides to do with it remains the company’s decision.
Our work
Unless otherwise stated, the original writing, design, methodology, names, marks and other material created by Kill Dull belong to Kill Dull or its respective rights holder.
You may read it, link to it and quote reasonable portions with attribution. You may not reproduce, republish, sell or present substantial portions of Kill Dull’s work as your own without permission.
Other people’s work
Kill Dull may cite, discuss or link to research, companies, brands and work belonging to others. Their rights remain theirs. A reference does not imply endorsement, affiliation or approval unless we explicitly say so.
Acceptable use
Don’t use the site to interfere with its operation, compromise its security, gain unauthorized access, introduce malicious software or violate applicable law.
That seemed worth writing down.
Links
Links to third-party websites are provided for reference and convenience. Kill Dull does not control those sites or accept responsibility for their content, availability or practices.
Availability
We may change, correct, remove or discontinue parts of the public site without notice. Where we discover a material error in something we have published, our preference is to correct the record.
Liability
The public site is provided on an “as available” basis. To the extent permitted by law, Kill Dull does not guarantee that the site will always be available, error-free or suitable for a particular purpose and is not responsible for losses arising solely from reliance on public-site content.
Nothing in these terms excludes or limits liability where doing so would be unlawful.
Changes
We may update these terms as the site changes. The current version will be published here.
